We comply with the U.S. Foreign Corrupt Practices Act (FCPA), the U.K. Bribery Act 2010 and the Guatemalan Ley Contra la Corrupción. Facilitation payments, kickbacks and any form of corrupt inducement to public officials, customs agents or counterparties are strictly prohibited.
2. Anti-Money-Laundering (AML)
Royal Spices is a Persona Obligada under Guatemalan AML law (Decreto 67-2001 and Decreto 58-2005, supervised by the Intendencia de Verificación Especial — IVE/SIB). We perform Know-Your-Customer (KYC) and Know-Your-Supplier (KYS) onboarding on every counterparty, including ultimate beneficial-owner identification, source-of-funds verification and ongoing transaction monitoring.
3. International Sanctions
All counterparties, vessels and financial intermediaries are screened against the consolidated lists of OFAC (U.S. Treasury), the EU Restrictive Measures, HM Treasury (UK), the UN Security Council and Guatemala's IVE list. We will not transact with sanctioned persons, vessels or jurisdictions, nor accept payment routed through sanctioned banks.
4. Trade Controls & Dual-Use
Our products (HS 0908, 0904, 0907) are agricultural commodities and are not subject to dual-use export-control regimes. Phytosanitary, origin and pre-shipment inspection certificates are issued in accordance with the importing country's requirements.
5. Payment Milestones & Letter-of-Credit Compliance
The first shipment with any new counterparty is settled by T/T bank wire on a milestone split of 20/80, 25/75 or 30/70 (advance vs. balance against scanned Bill of Lading), as fixed in the signed proforma. From the second shipment onward, and only after the first contract has settled cleanly, we also accept irrevocable, confirmed Letters of Credit at sight, Documentary Collections (URC 522) or Cash Against Documents. All L/Cs are governed by UCP 600 and ISBP 821. Document presentation is centralised through our authorised banks in Guatemala.
6. Tax & Beneficial Ownership
Royal Spices Guatemala S.A. is a Guatemalan-incorporated tax resident, registered with SAT (Tax ID available on request). Beneficial-ownership information is filed with the Guatemalan Registro Mercantil and is shared with banks under standard KYC processes.
7. Reporting Concerns
Suspected breaches of law or this statement may be reported confidentially through our Ethics & Whistleblower channel (see /ethics). Reports are reviewed by senior management and may be escalated to competent authorities.
